LIV ASTA PRIVATE LIMITED · LA-GUEST-01 · Version 2.1 · In force from 28 October 2026 · livasta.com/policies/guest/staying-guest-agreement
This Staying Guest Agreement ("Agreement") is made between LIV ASTA PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 (CIN U52291DC2026PTC473382), registered office at Plot 2, District Centre, Shivaji Place, Raja Garden, Rajouri Garden, New Delhi – 110027 ("Livasta", "we", "us", "our"), operator of the Livasta platform at livasta.com and in the Livasta app (the "Platform"), and every person who books or stays at a Listing through the Platform for overnight, short-term or extended accommodation (the "Guest", "you", "your").
This Agreement supplements the Livasta Terms & Conditions published on livasta.com (the "Terms") and governs every accommodation Booking. A Booking made mainly to hold an event, celebration, gathering, shoot or function is governed by the Party and Event Guest Agreement (LA-GUEST-02) instead.
By sending a booking request, booking with Instant Book, accepting a host booking link, paying for a Booking, checking in, or otherwise occupying a Property booked through the Platform, you confirm that you have read and agree to be bound by: this Agreement; the Terms; the Privacy Policy; the Cancellation, Refund & Guest Protection Policy; and the policies listed in Schedule 1, each as published on livasta.com when you book.
1. Scope
This Agreement applies to every Booking made for accommodation, including:
- overnight and short-term stays; holiday and vacation rentals; homestays;
- villas, farmhouses, apartments, independent houses and serviced apartments;
- business and corporate stays, temporary housing and Extended Stays (28 nights or more); and
- time-slot (day-use) stays where the Host offers them.
It does not apply to Bookings made mainly for parties, celebrations, weddings, corporate or community events, commercial venue hire, shoots, workshops or ticketed events. Those are governed by the Party & Event Guest Agreement (LA-GUEST-02). Holding an event under an accommodation Booking without approval is a material breach (section 11.3).
2. Definitions
Capitalised terms not defined here have the meaning given in the Terms. In this Agreement:
| Term | Meaning |
|---|---|
| Booking | A reservation for accommodation at a Property made through the Platform and confirmed under section 6.5. |
| Booking Confirmation | The electronic confirmation Livasta sends by email and shows in the app once a Booking is confirmed. |
| Booking Period | The time from Check-in to Check-out shown in the Booking Confirmation. |
| Check-in / Check-out | The start and end of your right to occupy the Property, at the times shown on the Listing or Booking Confirmation. |
| Additional Guest | Anyone staying overnight beyond the number of guests stated in the Booking. |
| Extended Stay | A Booking of 28 consecutive nights or more. |
| Host | The person or business that lists and provides the Property. |
| House Rules | The Property-specific rules set by the Host and shown on the Listing and at checkout. |
| Listing | The description of the Property published by the Host on the Platform. |
| Occupancy Limit | The maximum number of guests stated on the Listing. |
| Platform Fee | The Livasta service fee shown at checkout (see LA-GUEST-03). |
| Property | The accommodation described in the Listing. |
| Slot Booking | A same-day, time-based Booking of a set number of hours, where the Host offers it. |
| Visitor | Anyone you allow into the Property who is not a registered guest on the Booking. |
| Applicable Law | All laws, rules, regulations, notifications, orders and lawful directions in force in India, including local municipal and police requirements. |
3. Interpretation
- Headings are for convenience only.
- The singular includes the plural and vice versa; a person includes any individual, company or other body.
- "Including" means "including without limitation".
- A reference to a law includes any amendment or re-enactment of it and rules made under it.
- If this Agreement conflicts with a Schedule 1 policy on a guest-specific matter, this Agreement prevails; Applicable Law prevails over both.
4. Livasta's role
Livasta operates an online marketplace. It facilitates discovery, communication, booking and payment collection between Guests and Hosts. Unless a Listing expressly says that Livasta operates the Property, Livasta is not the owner, operator or provider of any Property and is not a party to the accommodation itself: the contract for the stay is between you and the Host.
Livasta is not an insurer, and does not guarantee a Host's performance or a Guest's payment obligations beyond what this Agreement, the Cancellation, Refund & Guest Protection Policy and Applicable Law provide.
5. Eligibility and your account
- You must be at least 18 years old and legally able to enter into a contract.
- You must give accurate, current and complete information about yourself, the people staying, your contact details, your intended stay and your payment, and keep it up to date.
- You are responsible for your account credentials and for everything done through your account.
- The person who makes the Booking should normally be one of the guests staying. Booking for someone else is allowed only if the Host agrees through the Platform and the person staying also accepts this Agreement.
- You must complete identity verification before booking (section 8).
Livasta or the Host may refuse or cancel a Booking where false information is given, verification cannot be completed, fraud is reasonably suspected, the Booking would break Applicable Law or this Agreement, or it creates an unacceptable safety risk.
6. How a Booking is made
6.1 Types of Booking
| Type | How it works |
|---|---|
| Instant Book | You pay at checkout and the Booking is confirmed immediately. |
| Request to Book | You send a request; the Host has 24 hours to accept or decline. You can pay only after the Host accepts. A request the Host does not answer in time expires. (Request to Book is the default for new Listings.) |
| Host booking link | The Host sends you a link for specific dates and price. The link holds the dates for 24 hours. You accept it while signed in as a guest with verified identity, then pay at checkout. |
| Slot Booking | Where the Host offers time slots, you book a set number of hours (3 hours or more) at the Host's slot price, ending by 11:00 pm. |
6.2 Information we need
Your full legal name, mobile number, email address, the number of adults, children and pets, check-in and check-out dates (or slot times), any special requests, and your payment. Some Properties or Applicable Law may require your address or the purpose of your stay.
6.3 Checkout holds
While you complete payment the dates are held for you. An unpaid checkout is released after 30 minutes so others can book the dates.
6.4 Accuracy
You must keep your Booking information accurate and tell the Host through the Platform about any material change.
6.5 When a Booking becomes binding
A Booking becomes a binding contract only when all of the following have happened:
- your identity verification is approved;
- the Host has accepted (for Request to Book and host booking links);
- payment is successfully captured; and
- Livasta has issued the Booking Confirmation.
Sending a request or starting checkout does not create a contract.
7. Price, payment and fees
You must pay the total shown at checkout. It is made up of the nightly rate (or slot price), any extra-guest charges, any cleaning fee set by the Host, and the Livasta Platform Fee. All amounts are in Indian Rupees and the total is rounded to the nearest rupee. Livasta does not currently charge GST on bookings. Details are in the Booking, Payments and Fees Policy (LA-GUEST-03).
- Payments are collected by Livasta's payment partner, Razorpay (cards, UPI, net banking and wallets as available). Livasta never sees or stores your full card details.
- Unless the Platform says otherwise, the full amount is payable before the Booking is confirmed.
- If a payment fails, is reversed or cannot be processed, the Booking may be suspended or cancelled and you may be refused check-in.
- All payments for a Booking — including any extra charges agreed with the Host — must be made through the Platform. Paying a Host outside the Platform is not allowed and removes Livasta's protections.
- Before raising a chargeback with your bank, you must first try to resolve the matter through Livasta support (LA-GUEST-16).
8. Identity verification
Identity verification (KYC) is required before you can book. It is done once and also counts for the host role. Livasta asks only for masked documents. Details, including how documents are read and kept, are in the Guest Identity Verification (KYC) Policy (LA-GUEST-05).
The Host may also ask every adult guest to show identity at check-in where Applicable Law or local police registration requires it. Foreign nationals must comply with Indian immigration and guest-registration requirements (see LA-GUEST-15).
If verification cannot be completed, Livasta or the Host may refuse check-in, require further verification, suspend or cancel the Booking, and report suspicious activity to the authorities where the law requires.
9. Changes to a Booking
You may ask through the Platform to change your dates, the number of guests or extra services. A change takes effect only when the Host approves it (where needed), any extra amount has been paid through Livasta, and an updated Booking Confirmation has been issued. Changes are subject to availability and may change the price, extra-guest charges and Platform Fee. A change that shortens the stay or reduces guests may be treated as a partial cancellation under LA-GUEST-04.
10. Check-in, check-out and occupancy
Check-in and check-out happen at the times shown on the Listing or Booking Confirmation. Before check-in you must complete any verification and registration the Host or the law requires. The number of overnight guests must never exceed the Occupancy Limit; Additional Guests and Visitors need the Host's approval. You must leave on time and return all keys and access devices. Details are in the Check-in, Check-out and Occupancy Policy (LA-GUEST-06).
11. Use of the Property and your conduct
11.1 Residential use
The Property may be used only for the accommodation booked, lawfully, and in line with this Agreement, the House Rules (which you accept at checkout) and the Code of Conduct in LA-GUEST-07.
11.2 No commercial use
Unless the Host and Livasta agree in writing, you must not run a business from the Property, sublet it or let others pay to stay, hold commercial shoots, trainings, workshops or exhibitions, or use it as an office or warehouse.
11.3 No unapproved events
You must not hold or allow parties, celebrations, weddings, corporate or promotional events, ticketed events or other gatherings without the Host's prior approval through the Platform and, where applicable, Livasta's. Approved events are governed by LA-GUEST-02.
11.4 Responsibility for others
You are responsible for everyone who stays at or visits the Property through your Booking — family, companions, children, Visitors, staff you bring and pets. A breach by any of them is treated as your breach.
11.5 Prohibited activities
Unlawful activity of any kind is prohibited, including illegal drugs, violence, harassment, discrimination, trafficking, exploitation, illegal gambling, illegal weapons, fraud and cybercrime (full list in LA-GUEST-07).
12. Host access and privacy inside the Property
During the Booking Period the Host may enter the Property only with your consent, in an emergency, for urgent repairs that cannot wait until after check-out, where the law requires, or as stated in the House Rules — with reasonable prior notice except in an emergency.
Security cameras and recording devices must be disclosed on the Listing and must never be placed in bedrooms, bathrooms or other areas where people expect privacy. Report any undisclosed or hidden device to Livasta immediately (LA-GUEST-08).
13. Damage, cleaning and deposits
You are responsible for loss or damage to the Property caused by you, your companions, Visitors or pets, other than reasonable wear and tear. Report accidental damage promptly. Hosts may claim for damage, missing items and extra cleaning through Livasta; you will always be told about a claim and given a fair chance to respond before any decision. Details are in the Damage, Cleaning and Security Deposit Policy (LA-GUEST-09).
A security deposit applies only if one is clearly shown on the Listing and at checkout before you pay.
14. Cancellations and refunds
You may cancel through the Platform. The refund depends on when you cancel, and the exact amount is shown before you confirm. The rules — including the 24-hour grace period, no-shows, early departure, Host cancellations, Guest Protection and force majeure — are in the Cancellation, Refund and Guest Protection Policy (LA-GUEST-04) and follow the published Cancellation, Refund & Guest Protection Policy.
| When you cancel | Refund of stay charges |
|---|---|
| 7 or more days before check-in | 100% |
| Less than 7 days but at least 48 hours before check-in | 50% |
| Less than 48 hours before check-in | No refund |
| After check-in | No refund for unused nights (Guest Protection exceptions apply) |
If the Host or Livasta cancels a confirmed, paid Booking, you receive a full refund including the Platform Fee.
Livasta may suspend or cancel a Booking where it reasonably believes that this Agreement has been materially breached, fraud is involved, verification is incomplete, payment has failed, the law requires it, public safety is at risk, or continuing would expose the Host or Livasta to serious legal or safety risk. Any refund then follows LA-GUEST-04 and Applicable Law.
15. Problems during your stay
If something is wrong — the Property is unavailable, materially different from the Listing, unsafe, unclean, or an essential service fails — tell the Host through the Platform straight away, keep photos and messages, and report it to Livasta as soon as possible (preferably within 24 hours of finding it and no later than 72 hours). Remedies range from a fix by the Host to a partial or full refund or help with rebooking (LA-GUEST-04).
16. Reviews and messages
After a completed stay you may review the Property honestly. Messages with the Host must stay on the Platform where possible and must never be used to arrange off-platform payment. See LA-GUEST-10.
17. Your personal data
Livasta processes your personal data under its Privacy Policy and the Digital Personal Data Protection Act, 2023. What is collected for bookings and verification, what is shared with the Host, how long it is kept and your rights are summarised in the Guest Privacy and Data Protection Notice (LA-GUEST-11).
18. Health, safety and emergencies
Take reasonable care for everyone's safety, do not tamper with smoke detectors, fire extinguishers or other safety equipment, and report fires, gas or water leaks, electrical faults, crimes and medical emergencies at once. In an emergency call 112 first, then tell the Host and Livasta. See the Guest Safety, Security and Emergency Policy (LA-GUEST-08).
19. Insurance
Unless a Listing expressly says otherwise, Livasta does not insure your belongings, medical costs, travel disruption, cancellation losses or personal liability. You are encouraged to take suitable travel, health and personal-accident insurance.
20. Your promises
You confirm that:
- all information you give is true and complete, and the Booking is for a lawful purpose;
- you will not use a false identity or a payment method you are not authorised to use, and payments come from lawful sources;
- you will not reverse a payment without a genuine reason;
- you and everyone with you will follow this Agreement, the House Rules and Applicable Law; and
- you will pay all amounts due under this Agreement on time.
21. Breaches and enforcement
Material breaches include unapproved events, guests above the Occupancy Limit, repeated noise complaints, intentional damage, violence, criminal or drug activity, serious safety violations and serious breaches of the House Rules.
Acting reasonably and in proportion, Livasta or the Host may give a warning, require you to stop, charge reasonable costs allowed by this Agreement, cut the Booking short or require you to leave, and Livasta may restrict, suspend or close your account. Enforcement steps and how to appeal are in the Guest Trust and Safety Enforcement Policy (LA-GUEST-12).
22. Liability
To the extent permitted by Applicable Law:
- Livasta is not liable for the acts or omissions of Hosts, other guests or third parties, or for the condition, safety or legality of a Property, beyond the remedies in the Cancellation, Refund & Guest Protection Policy;
- Livasta is not liable for indirect, incidental, special or consequential loss, or loss of profit, opportunity or goodwill; and
- Livasta's total liability to you arising out of or relating to the Platform or a Booking is limited to the Livasta fees you paid in the three (3) months before the event giving rise to the claim, as stated in the Terms.
Nothing in this Agreement limits liability that cannot lawfully be limited, including for fraud or wilful misconduct, or any non-waivable right you have as a consumer.
23. Indemnity
To the extent permitted by Applicable Law, you will compensate Livasta and its officers and staff for third-party claims, losses and reasonable legal costs arising from your breach of this Agreement, your unlawful conduct, damage or injury caused by you or anyone staying or visiting through your Booking, or false information you gave.
24. The Platform and content
Livasta grants you a limited, personal, revocable licence to use the Platform to make and manage Bookings. You must not copy, scrape, reverse-engineer, interfere with or misuse the Platform. Content you post (reviews, photos, messages) is covered by LA-GUEST-10.
25. Electronic records and notices
This Agreement is an electronic record under the Information Technology Act, 2000 and is accepted electronically. Livasta's electronic records of Bookings, payments and messages may be relied on as evidence, subject to Applicable Law. Notices may be sent by email, SMS, WhatsApp (where you have agreed), in-app notification or on your account.
26. Force majeure
Neither Livasta nor the Host is liable for failure or delay caused by events beyond reasonable control — for example natural disasters, floods, earthquakes, cyclones, fire, epidemics with legal restrictions, war, terrorism, civil unrest, government orders or evacuations, or major infrastructure failure. Routine personal circumstances (a change of plans, ordinary illness, work changes, a missed flight where travel is still possible) are not force majeure. Refunds follow LA-GUEST-04.
27. Disputes, governing law and jurisdiction
Raise any complaint first through Livasta support so it can be resolved quickly (Guest Grievance Redressal and Dispute Resolution Policy (LA-GUEST-16)). Livasta may help the Host and you reach a settlement; that help is not arbitration and does not decide your legal rights.
This Agreement is governed by the laws of India. A dispute not resolved amicably will be referred to arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator, seated in New Delhi, in English. Subject to that, the courts at New Delhi have exclusive jurisdiction, including for interim relief and enforcement.
Nothing in this section removes your right, as a consumer, to approach a Consumer Commission under the Consumer Protection Act, 2019.
28. General
- Whole agreement. This Agreement, the Terms, the Privacy Policy and the Schedule 1 policies are the whole agreement for accommodation Bookings.
- Changes. Livasta may update this Agreement. Material changes will be notified on the Platform before they apply; the version in force when you booked applies to that Booking, except where a change is required by law or for safety or fraud prevention.
- Assignment. You may not transfer a Booking or this Agreement. Livasta may assign it as part of a reorganisation, merger or sale without reducing your rights.
- Waiver and severability. Not enforcing a right is not a waiver; if a provision is invalid, the rest continues.
- Relationship. Nothing here creates a partnership, agency or employment between you and Livasta.
- Survival. Payment obligations, damage claims, indemnities, liability limits, privacy and dispute provisions survive the end of a Booking.
29. Acceptance
You accept this Agreement electronically when you book, pay, accept a host booking link, check in or stay. Livasta records the version you accepted with the Booking.
