LIV ASTA PRIVATE LIMITED · LA-HOST-01 · Version 2.1 · In force from 28 October 2026 · livasta.com/policies/host/host-agreement

Part I — Preliminary

1. Parties and acceptance

This Host Agreement ("Agreement") is entered into between LIV ASTA PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, CIN U52291DC2026PTC473382, having its registered office at Plot 2, District Centre, Shivaji Place, Raja Garden, Rajouri Garden, New Delhi, West Delhi – 110027, Delhi, India ("Livasta", "Company", "we", "our", "us"), and every individual or legal entity that registers, or seeks to register, as a Host on the Livasta platform ("Host", "you", "your").

This Agreement is an electronic contract and electronic record under the Information Technology Act, 2000. By creating a Host account, completing Host verification, publishing a Listing, accepting a Booking or otherwise using Host services, you agree to be bound by this Agreement and the policies listed in Schedule 1, as updated from time to time.

2. Definitions

In this Agreement, unless the context requires otherwise:

  • "Booking" — a reservation made through the Platform and confirmed after successful payment.
  • "Booking Service Fee" — the platform fee deducted from a Booking under the Host's active Hosting Plan.
  • "Business Host" — a company, LLP, partnership, trust or other entity that lists Properties.
  • "Calendar" — the availability calendar a Host maintains for each Listing, including any synchronised external calendars.
  • "Guest" — a person who books or stays at a Property through the Platform, including any person staying under that Booking or attending a permitted event.
  • "Guest Service Fee" — the platform service fee paid by a Guest on a Booking, shown at checkout.
  • "Hosting Plan" — the subscription tier a Host selects (for example Starter, Growth or Pro), which determines the Host's fees and features.
  • "Host Content" — photographs, videos, descriptions, prices, house rules, messages and any other content a Host uploads.
  • "Host Dashboard" — the Host area of the Platform used to manage Listings, Calendars, Bookings, earnings and verification.
  • "Host Booking Link" — a shareable link a Host creates for selected dates, which holds those dates for a limited time for a specific Guest.
  • "Instant Book" — a Listing setting under which eligible Bookings are confirmed without manual Host approval.
  • "Listing" — a Property published on the Platform after Livasta's approval.
  • "Masked Document" — an identity document on which identifying numbers are hidden, such as a Masked Aadhaar showing only the last 4 digits.
  • "Payout" — the amount payable to a Host for a Booking after deduction of fees, taxes and other permitted amounts.
  • "Platform" — the Livasta website (livasta.com), mobile and web applications and related services.
  • "Property" — any residential, commercial, hospitality or event premises offered through the Platform.
  • "Request to Book" — a Listing setting under which a Guest's request must be accepted by the Host within the response period.
  • "Slot Booking" — an hourly or same-day booking offered on a Property where the Host has enabled it.
  • "Verification" — identity, document, payment, property or fraud-prevention checks carried out by or for Livasta.

3. Interpretation and order of precedence

  • Headings are for convenience only. Words in the singular include the plural. "Including" means "including without limitation". References to laws include amendments and successor laws.
  • This Agreement must be read with the Livasta Terms & Conditions, Privacy Policy, Cancellation, Refund & Guest Protection Policy and the policies in Schedule 1.
  • On matters specific to Hosts, this Agreement prevails over the Terms & Conditions to the extent of any inconsistency. A policy in Schedule 1 prevails over this Agreement only on the operational detail it is written to cover.

4. Livasta's role

Livasta operates an online marketplace and intermediary that connects Guests with Hosts. The accommodation contract is between the Guest and the Host. Livasta facilitates discovery, communication, booking and payment collection, but is not the owner, operator, manager, lessor or insurer of any Property and is not a party to the stay itself, unless expressly stated otherwise.

Part II — Eligibility, registration and verification

5. Eligibility

  • You must be at least 18 years old and legally competent to contract under Indian law.
  • You must have the lawful authority to list the Property, receive Guests, accept Bookings and receive payments for it.
  • Hosts may include owners, co-owners, lessees with the right to sub-let, property management companies, hotels, guest houses, homestays, villas, serviced apartments, event venue operators and authorised agents.
  • You may not register as a Host if you are a minor, use a false identity, are suspended or blacklisted on the Platform, are prohibited by law, have been convicted of fraud involving hospitality services, or lack legal authority over the Property.
  • You must continue to meet these requirements throughout this Agreement and tell Livasta immediately if you no longer do.

6. Registration and account

  • You must register through the Host Dashboard and provide accurate, current and complete information, which may include your name, mobile number, email, residential address, bank details, GST details (where registered), business registration (for Business Hosts) and Property details.
  • Unless Livasta approves otherwise, each individual may keep only one Host account; a Business Host may keep one verified Business Host account.
  • You are responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately at support@livasta.com about any unauthorised use.

7. Identity verification (KYC)

  • Completing verification is mandatory before any Listing is published. The documents, process and data handling are set out in the Host Identity Verification (KYC) Policy (LA-HOST-04).
  • Livasta accepts masked documents only for identity verification. Hosts must not upload unmasked identity numbers; where a full Aadhaar number appears, Livasta hides all but the last 4 digits before storing the image.
  • Verification is done once per person: a verification approved for your Guest account counts for your Host account and vice versa.
  • Livasta may re-verify a Host at any time, including when documents expire, ownership changes, suspicious activity occurs or the law changes, and may refuse verification where permitted by law.
  • Verification is not a guarantee of a Host's identity, integrity, ownership, financial standing or future conduct.

8. Host representations and warranties

You represent and warrant, and repeat each time you accept a Booking or keep a Listing active, that:

  • all information and documents you provide are true, accurate, genuine and complete;
  • you have the lawful authority to list and let the Property;
  • the Property and your hosting comply with all applicable laws, permits, building and society rules, safety requirements and tax obligations;
  • your Listings and photographs accurately represent the Property and contain no misleading information;
  • the Property is safe, clean and fit for its intended use;
  • you will comply with this Agreement and all Platform policies; and
  • you will promptly tell Livasta of any material change affecting the Property or your eligibility.

A breach of any representation or warranty is a material breach of this Agreement.

9. Authority to list and property documents

  • You must hold, and on request provide, documents showing your right to list the Property (for example a sale or conveyance deed, registered lease with permission to sub-let, owner's authorisation, or management agreement), as described in the Listing Standards & Property Documentation Policy (LA-HOST-05).
  • Where a Property is owned or leased by someone else, you confirm that the owner, landlord, housing society or building association permits short-term stays and any events you offer.

10. Licences, registrations and local rules

  • You are responsible for obtaining and keeping every licence, registration or permission your Property and hosting require, such as state homestay or bed-and-breakfast registration, trade or tourism licences, fire safety approval for commercial premises, and any police or local-authority requirements.
  • Where a Guest is a foreign national, you must comply with foreigner arrival reporting (Form C to the FRRO within 24 hours of arrival, or as the law then requires) and any guest-register obligations that apply to you.
  • You must comply with tax laws as set out in Article 23 and the Host Legal & Tax Compliance Guide (LA-HOST-15).

11. Safety and insurance

  • You must keep the Property safe and meet the Safety, Security, Surveillance & Emergency Policy (LA-HOST-07), including smoke detection, a fire extinguisher, a first-aid kit and displayed emergency numbers where reasonably applicable.
  • Livasta is not an insurer and does not insure Hosts, Guests or Properties. You are encouraged to maintain insurance suitable for short-term letting (property, contents and public liability).

12. Guest identity at check-in

Where the law requires you to verify or record a Guest's identity at check-in, you may do so, but you must collect only what the law requires, keep it secure, use it only for that purpose and delete it when no longer required, in line with the Host Data Protection & Guest Privacy Policy (LA-HOST-11). You must not demand unmasked Aadhaar copies.

Part IV — Listings, pricing and bookings

13. Listings

  • You may create one or more Listings through the Host Dashboard. Every Listing is reviewed and must be approved by Livasta before publication; approval is not a certification of legal compliance.
  • Listings must accurately describe the Property, its amenities, restrictions, house rules, check-in and check-out times, maximum occupancy, prices and fees, and must be kept up to date. Detailed standards are in LA-HOST-05.
  • Livasta may approve, reject, request changes to, temporarily suspend or remove any Listing that does not comply with this Agreement, the policies or the law.

14. Host Content and licence

  • You keep ownership of your Host Content. You warrant that you own it or have the right to use it, that photographs are recent and genuine, and that it infringes no one's rights.
  • You grant Livasta a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt for formatting or technical purposes, translate, display, distribute and use Host Content to operate, promote and improve the Platform, sub-licensable only to Livasta's service providers for those purposes. The licence lasts for the term of this Agreement and afterwards only as needed for legal compliance, records and disputes.

15. Pricing and additional charges

  • You set the nightly price, any weekend or special-date prices, any cleaning fee and, where Slot Bookings are enabled, slot prices for each Listing.
  • All charges must be shown to the Guest before payment. You must not ask Guests to pay any charge outside the Platform.
  • Livasta may offer optional pricing suggestions; they are advisory and you remain responsible for your prices.
  • Where an obvious pricing error is caused by a system fault, fraud or typing mistake, Livasta may hold or cancel the affected Booking while it is resolved under the applicable policies.

16. Availability and calendar

  • You must keep each Calendar accurate and block dates that are not available. You must take all reasonable steps to prevent double bookings across every channel.
  • Where you connect external calendars (for example Airbnb or Booking.com) through calendar synchronisation, you remain responsible for checking that synchronisation works. Detailed rules are in the Bookings, Calendar & Instant Book Policy (LA-HOST-06).

17. Instant Book and Request to Book

  • Each Listing uses either Instant Book or Request to Book. Under Instant Book, eligible paid Bookings are confirmed automatically, subject to Livasta's risk checks.
  • Under Request to Book, you must accept or decline within the response period shown on the Platform (currently 24 hours); unanswered requests expire automatically.
  • You may decline only for legitimate, lawful and non-discriminatory reasons, such as unavailability, unmet published booking requirements or reasonable safety concerns.
  • A Booking becomes binding only after Host acceptance (where required), successful payment and confirmation by Livasta.

18. No off-platform transactions

You must not solicit, encourage or accept payments or bookings outside the Platform for enquiries or Guests that came through Livasta, or otherwise try to avoid Livasta's fees. Doing so may lead to cancellation of the Booking, withholding of Payouts where lawful, suspension or termination.

19. Non-discrimination

You must not refuse, cancel, discourage or treat Bookings differently on the basis of race, caste, ethnicity, religion, gender, sexual orientation, disability, nationality, marital status or any other characteristic protected by law. See the Community Standards & Host Code of Conduct (LA-HOST-10).

Part V — Fees, payments and taxes

20. Hosting Plans and fees

You agree to pay the fees of your selected Hosting Plan — the plan fee (monthly or annual) and the Booking Service Fee — as displayed on the Host Dashboard and plan selection screen before you activate or change a plan, and as described in the Fees, Payments & Payouts Policy (LA-HOST-02). Livasta may change its fees with reasonable prior notice; fees already shown for a confirmed Booking or a paid plan period do not change.

21. Collection of payments

You appoint Livasta, through its payment partner Razorpay, as your limited agent to collect Booking payments from Guests on your behalf, deduct fees and permitted amounts, process refunds and chargebacks, and pay you the Payout. A Guest's payment to Livasta is treated as payment to you for that Booking.

22. Payouts

  • Your Payout is the Booking amount less the Booking Service Fee, any taxes Livasta must withhold or collect (such as TDS or TCS), approved refunds, chargebacks, penalties and any other amount permitted under this Agreement.
  • Payouts are made to your verified bank account according to the payout schedule in LA-HOST-02, after the Guest's stay, unless delayed for legal, fraud-prevention, dispute or compliance reasons.
  • Livasta may temporarily withhold a Payout where reasonably necessary to investigate fraud, resolve a dispute, comply with a court or regulatory order, recover amounts you owe, or investigate a suspected breach.

23. Taxes

  • You are responsible for determining, reporting and paying all taxes on your hosting income, including GST where you are required to register and income tax, except where the law requires Livasta to collect, deduct, pay or report tax.
  • Where required by law, Livasta may deduct tax at source (TDS) or collect tax at source (TCS) from Payouts and will provide the prescribed statements.
  • You must give Livasta the tax information it reasonably requests (such as PAN and GSTIN) and cooperate with lawful tax enquiries. See LA-HOST-15.

24. Refunds and chargebacks

Refunds are governed by the Cancellation, Refund & Guest Protection Policy and LA-HOST-03. Where a refund is approved or a payment is reversed by a bank or card network, Livasta may recover the corresponding amount from your future Payouts or otherwise, to the extent you received it. You must provide the information and evidence reasonably requested to resolve a refund, dispute or chargeback.

25. Statements and records

Livasta makes earnings statements available on the Host Dashboard. You must tell Livasta of any material error within 30 days of a statement becoming available; this does not affect your statutory rights. You must keep financial records relating to your Bookings for the period the law requires. Livasta's electronic records are prima facie evidence of transactions, subject to proof to the contrary.

Part VI — Cancellations, damage, reviews and disputes

26. Cancellations and refunds

Guest cancellations and refunds follow the Cancellation, Refund & Guest Protection Policy published on livasta.com (currently: 100% refund of stay charges when cancelled 7 or more days before check-in, 50% when cancelled at least 48 hours but less than 7 days before, and no refund within 48 hours or after check-in, with a 24-hour grace period for eligible bookings and platform fees as stated in that policy). The cancellation terms shown to the Guest at checkout and in the booking confirmation apply to that Booking.

27. Host cancellations and no-shows

  • You must honour every confirmed Booking. You may cancel only for legitimate reasons (for example the Property becoming unsafe or uninhabitable, natural disaster, government restriction, serious illness or death in the immediate family, or a fraudulent Booking), and you must tell Livasta and the Guest immediately.
  • You must never cancel to obtain a higher price, because of overbooking, or for a discriminatory reason.
  • When you cancel a paid Booking, the Guest receives a full refund and you forfeit an amount equal to the Livasta service fee for that Booking (deducted from your Payout, down to ₹0); repeated cancellations may lead to lower search ranking, loss of Instant Book or badges, suspension or removal. Details and the circumstances in which penalties are waived are in LA-HOST-03.
  • If the Property is unavailable, inaccessible or materially different from the Listing so that the stay cannot reasonably go ahead (a "Host No-Show"), the Guest is protected under the Guest Protection rules and the same consequences may apply.

28. Damage claims and security deposits

You may claim for damage caused by a Guest under the Damage Claims & Security Deposit Policy (LA-HOST-08), through the Platform, within the time limit and with supporting evidence. Ordinary wear and tear is not compensable. Knowingly submitting a false, inflated or fabricated claim is a material breach.

29. Reviews, ratings and performance

Guests may review completed stays. Reviews and ratings, Host performance measures and recognition programmes are governed by the Reviews, Ratings & Host Performance Policy (LA-HOST-09). You must not threaten, pressure or pay Guests to influence reviews.

30. Complaints and disputes

You must cooperate in good faith with investigations into Guest complaints, preserve relevant evidence and respond within the timelines Livasta specifies. Livasta may collect evidence, ask for explanations and make operational decisions (such as refunds or temporary account actions) reasonably and on the available evidence. The process is in the Grievance Redressal & Dispute Resolution Policy (LA-HOST-17); nothing in it limits your rights under law.

Part VII — Conduct, data and enforcement

31. Community standards and prohibited activities

You must follow the Community Standards & Host Code of Conduct (LA-HOST-10), including the list of prohibited activities. Using the Platform for any unlawful purpose (such as trafficking, exploitation, drugs, illegal gambling, money laundering or fraudulent listings) will result in immediate suspension, termination and reporting to the authorities.

32. Data protection

You must process Guest personal data only as needed to deliver the Booking and in line with the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, Livasta's Privacy Policy and the Host Data Protection & Guest Privacy Policy (LA-HOST-11). You must not sell Guest data, use it for unsolicited marketing, keep it longer than necessary, or misuse identity documents, and you must tell Livasta without undue delay of any actual or suspected breach.

33. AI and automated systems

Livasta may use automated systems, including document reading and AI tools, for identity verification, fraud prevention, support, risk assessment, pricing suggestions and content moderation, as described in the AI, Automation & Fraud Prevention Policy (LA-HOST-13). Decisions that significantly affect you, such as rejecting verification or suspending an account, are reviewed by a person.

34. Parties and events

You may allow parties or events only where your Listing says so and the Party & Event Hosting Policy (LA-HOST-14) and the law allow it.

35. Suspension and enforcement

Livasta may restrict, suspend or remove a Listing or Host account where there are reasonable grounds to believe you have breached this Agreement, committed fraud, provided false information, endangered Guest safety, acted unlawfully or failed mandatory verification, as set out in the Trust & Safety Enforcement Policy (LA-HOST-12). Immediate action may be taken where urgent protection is needed. You will be told the reason unless the law prevents it, and may ask for a review.

36. Termination

  • You may end this Agreement by closing your Host account, subject to completing or cancelling (under LA-HOST-03) your confirmed Bookings and settling amounts you owe.
  • Livasta may terminate this Agreement for material or repeated breach, fraud, legal or regulatory requirement, or where your continued participation poses a material legal, operational or safety risk.
  • On termination your Listings are removed, pending Payouts are processed subject to permitted deductions, and accrued rights and obligations continue.

Part VIII — General

37. Intellectual property

All rights in the Platform — software, databases, algorithms, AI models, designs, trademarks, the Livasta name and logos — belong to Livasta or its licensors. Livasta grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform only to manage your Listings and Bookings. You must not copy, scrape, reverse-engineer, resell or create derivative works from the Platform. Livasta may use feedback you give without obligation.

38. Confidentiality

You must keep confidential any non-public information about Livasta's business, pricing models, systems, security or other users that you receive, use it only for this Agreement and protect it with reasonable care. This does not apply to information that is public without your breach, already lawfully known to you, independently developed, or required to be disclosed by law (with notice to Livasta where lawful). These obligations survive for five years after termination, and for trade secrets for as long as they remain trade secrets.

39. Indemnity

You will defend, indemnify and hold harmless Livasta, its affiliates, directors, officers, employees and agents against losses, liabilities, claims, penalties, fines and reasonable legal fees arising from your breach of this Agreement or the law, inaccurate Listings, property damage or personal injury caused by your acts or omissions, infringement by your Host Content, taxes attributable to you, or your fraud, negligence or wilful misconduct. The indemnified party will take reasonable steps to mitigate its losses.

40. Limitation of liability

  • To the maximum extent permitted by law, Livasta is not liable for indirect, consequential, special, exemplary or punitive damages, or loss of profits, goodwill, business or data.
  • Livasta's total liability to you arising out of or relating to this Agreement is limited to the fees you paid to Livasta in the twelve (12) months before the event giving rise to the claim.
  • Nothing in this Agreement limits liability that cannot lawfully be limited.

41. Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control, such as natural disasters, floods, earthquakes, epidemics, war, terrorism, riots, government action, major internet or power outages, or exceptional cyberattacks. The affected party must try to reduce the impact and resume performance as soon as reasonably possible. Guest refunds in such events follow the force-majeure section of the Cancellation, Refund & Guest Protection Policy.

42. Governing law and jurisdiction

This Agreement is governed by the laws of India. Subject to Article 43, the courts at New Delhi have exclusive jurisdiction.

43. Dispute resolution and arbitration

  • The parties will first try to resolve a dispute through good-faith negotiation within 30 days of written notice, and may agree to mediation.
  • Disputes not resolved this way will be finally settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by agreement or, failing that, in accordance with law. Seat and venue: New Delhi (virtual hearings if agreed). Language: English.
  • Either party may seek urgent interim relief from a competent court.

44. Notices

Livasta may give notices through the Platform, by email or SMS/WhatsApp to your registered contact details. Legal notices to Livasta must be sent to grievance@livasta.com and by registered post or courier to the registered office above.

45. Changes to this Agreement

Livasta may amend this Agreement or any Schedule 1 policy by giving reasonable prior notice through the Platform or by email. Material changes will take effect no earlier than the notice period stated in the notice. If you do not agree, you may close your Host account before the change takes effect; continuing to host after that date means you accept the change.

46. Assignment

You may not assign or transfer this Agreement without Livasta's prior written consent. Livasta may assign it to an affiliate or in connection with a merger, acquisition, restructuring or sale of substantially all its assets, subject to law.

47. Electronic acceptance

You accept this Agreement electronically, for example by ticking "I agree", by OTP confirmation or by continuing to host after notice. Livasta records the version accepted with the date and time of acceptance.

48. Survival, entire agreement, severability and waiver

  • Provisions that by their nature should survive termination do so, including payment obligations, taxes, damage claims, confidentiality, data protection, intellectual property, indemnity, limitation of liability, dispute resolution, governing law and record retention.
  • This Agreement, with the documents it incorporates, is the entire agreement between the parties on its subject.
  • If any provision is held invalid, the rest remains in force. Not enforcing a provision is not a waiver of it.
